Governor Issues Executive Order Temporarily Suspending Service of Garnishment Summonses

Gov. J.B. Pritzker’s office has issued an executive order temporarily suspending the service of garnishment summonses, wage deduction summonses, and citations to discover assets on consumer debtors and consumer garnishees for the duration of the Gubernatorial Disaster Proclamations.

It is effective immediately.

Much needed relief for the average Illinoisian, well done Governor Pritzker :)

So a commericial (versus consumer) debt collection still moves forward? 

What about supp proceedings which were served prior to the Executive Order's promulgation pursuant to which the bank sequestered the funds but did not pay them over to the jugdment creditor.  Must the funds be returned to the judgment debtor / depositor?  Any ideas?

Dick, the consensus of the Illinois Creditors Bar Association Board is that the Order affects service of new garnishments and Citations and does not require the cessation of matters already on file.  What people seem to forget is that the creditors rights bar is made of of attorneys who are, mostly, small business owners.  We have employees that we would like to pay and vendors who are paid, and, in turn, pay their employees.  The ILCBA members are taking the view prevalent in the industry that we should work with our consumer debtors and grant forbearances during the present crisis.  We would hope that our members, as well, receive the understanding of the agencies which have control over us.
