Generative AI & Legal Writing

Justice Michael B. Hyman of the First District of the Illinois Appellate Court, says, like sorcery, artificial intelligence-drafted content seems to draft itself. Lawyers can rapidly produce everything from motions and memos to case analyses, client communications, pleadings, and wills in seconds. While Justice Hyman has concerns about judges using generative AI in decision writing and reasoning, he suggests generative AI seems a dream come true for lawyers. But he warns that dream can quickly turn into a nightmare, considering the potential for breaches of confidentiality, ethical violations, misinterpretations of legal concepts, flawed arguments, and factual inaccuracies. In his Judging Your Writing column, “Generative AI & Legal Writing”  in the May Illinois Bar Journal, he discusses ways to minimize these risks.
