Powering Up Your POAs

 In his September Illinois Bar Journal article, “Powering Up Your POAs,” attorney Gary R. Gehlbach shows how using the statutory form without significant additions and modifications is fraught in its acceptability by third parties. The problem is not with the comprehensiveness of the form or the statute, Gehlbach states. Rather, third parties whom clients wish to accept the Property POA are often loath to allow the designated agent to act on behalf of the principal unless the Property POA specifically authorizes the agent to do what the agent wishes to accomplish. Gehlbach goes on to provide practical ideas and guidance for effectively utilizing section 3 so that designated agents can handle routine financial matters with fewer roadblocks.
