Seeking Compatible 404(b) Rules of Evidence

“Compatible rules of evidence would certainly make life easier for lawyers who try cases in both federal and state courts,” writes Gino L. DiVito in his January Illinois Bar Journal article, “Seeking Compatible 404(b) Rules of Evidence.” In his article, DiVito, author of the Illinois State Bar Association’s “The Illinois Rules of Evidence: A Color-Coded Guide,” presents two recent examples of criminal-law compatibility with one aspect of Federal Rule of Evidence 404(b)—commonly referred to as the “other crimes rule.” Even with some compatibility, DiVito notes, important parts of the rule differ.
