Tazewell County v. Illinois Workers' Compensation Commission

Illinois Appellate Court
Civil Court
Workers' Compensation Act
Citation
Case Number:
2025 IL App (4th) 230754WC
Decision Date:
Friday, January 31, 2025
District:
4th Dist.
Division/County:
Tazewell Co.
Holding:
Affirmed.
Justice:
HOFFMAN

Claimant sought benefits under the Workers’ Compensation Act. The arbitrator denied the request for benefits finding that claimant failed to meet her burden of proving she sustained a compensable injury. The Illinois Workers’ Compensation Commission reversed and awarded temporary total disability. The circuit court affirmed the commission and respondent appealed. The appellate court affirmed the circuit court, finding that the evidence submitted during the arbitration hearing, including claimant’s testimony and medical records, was sufficient to support a finding that she sustained repetitive physical trauma as a result of her work-related duties as a dental hygienist. (HOLDRIDGE, CAVANAGH, and BARBERIS, concurring and MULLEN, dissenting)

Martin v. Goodrich Corp.

Illinois Supreme Court
Civil Court
Workers' Occupational Disease Act
Citation
Case Number:
2025 IL 130509
Decision Date:
Friday, January 24, 2025
Holding:
Certified questions answered.
Justice:
HOLDER WHITE

The Illinois Supreme Court considered three questions certified by the Seventh Circuit Court of Appeals pursuant to SCR 20. All of the rules dealt with an amendment to the Workers’ Occupational Diseases Act that allowed for workers barred by the Act’s exclusivity and repose provisions to instead pursue relief through a civil action. The Supreme Court answered the questions by finding that plaintiff was barred from bringing an action under the Act by a repose provision and that the prospective application of the recent exception did not violate the defendant’s right to due process under the Illinois constitution and that plaintiff's civil action could proceed pursuant to the recent amendment to the Act. (THEIS, NEVILLE, OVERSTREET, CUNNINGHAM, ROCHFORD, and O’BRIEN, concurring)
