Join us for an in-depth look at basic Illinois pretrial motion practice. Motions to Dismiss 2/615 and 2/619 are tools to prevent insufficient claims from proceeding to discovery. Learn their distinctions; the differences between these two motions and a 2-1005 Motion for Summary Judgment; combined 2/615 and 2/619 motions; and more. Discussion also includes a review of judicial admissions including party admissions, stipulations, requests to admit, as well as judicial notice, relevant Illinois Rules of Evidence; and more. Gain a better understanding of how to handle motions to vacate in your next family law case, including:
- How to set aside any final order or judgment;
- How to determine what is “final” in a judgment or order;
- What to do once you have determined the finality of the judgment;
- How to vacate an order or judgment within 30 days;
- Motions to vacate final orders or judgments after 30 days;
- Exceptions; and
- Requirements for notice under Supreme Court Rule 105 & 106.
