Plaintiffs filed a lawsuit alleging that their former employer had violated the Whistleblower Act and engaged in retaliatory discharge after the plaintiffs, who were former police offers, allegedly found evidence of criminal wrongdoing and reported their findings to state and federal authorities. The trial court granted summary judgment in favor of the defendants and plaintiffs appealed. The appellate court affirmed in part and reversed in part, finding that defendants’ motion for summary judgment failed to satisfy their initial burden of production but that the village enjoyed sovereign immunity from the retaliatory discharge claim. In 1920s Oklahoma, Native Americans were treated as second class citizens. In the book and movie, Killers of the Flower Moon, we learn the true story about how members of the Osage Tribe were cheated out of their wealth and murdered for their oil rights. Don’t miss this interactive presentation in which our speaker, Philip Bogdanoff, uses film clips from the movie to discuss the various laws that discriminated against the Osage Tribe and how William Hale schemed to murder members of the tribe and steal their wealth. Learn how attorneys today can help prevent bias and discrimination in the legal profession by examining what the attorneys in the 1920s did to fight the racial persecution of the Osage Tribe and aided in the conviction of Mr. Hale for murder.

About the Speaker: Philip Bogdanoff is a nationally recognized continuing legal education speaker. Previously, he served as an assistant prosecutor in Akron, Ohio for nearly thirty years. He worked closely with the police and often made charging decisions on long term investigations. Mr. Bogdanoff also argued cases before the Ohio Ninth District Court of Appeals and the Ohio Supreme Court before retiring as a senior assistant prosecutor. He still works as a special prosecutor and in 2022 argued three criminal cases before the Ohio Supreme Court. He has done over fifty presentations for prosecutor groups including the National District Attorneys Association. The appellate court reversed and remanded with instructions to enter a TRO, finding that the trial court incorrectly denied the TRO on the basis that plaintiff had an adequate remedy at law because the “adequate remedy” was not as clear, complete, or as practical and efficient as restoring the water service while the parties litigated the underlying merits of the case. Several fire alarm companies filed a lawsuit against the Village of Schaumburg seeking to enjoin an ordinance that required commercial and multi-family properties to route fire alarm signals directly to a regional emergency-dispatch center. Plaintiffs alleged that the ordinance violated the Contracts Clause and tortiously interfered with their contracts and prospective economic advantage. The district court granted summary judgment in favor of the defendant and plaintiffs appealed. The Seventh Circuit affirmed, finding that the plaintiffs failed to offer evidence that the ordinance caused their existing clients to breach their contracts or that the defendant intended to interfere with their business relationships. Plaintiffs filed a four-count complaint against the defendants challenging the validity of the city’s ordinances related to rental properties. The trial court granted the defendants’ motion to dismiss the complaint and plaintiffs appealed. The appellate court affirmed in part, reversed in part, and remanded, finding that the trial court properly dismissed plaintiffs’ facial challenges to the ordinance but that the trial court erred when it dismissed the plaintiffs’ claim that the ordinance was unconstitutional as applied. The court additionally held that under the Tort Immunity Act, the plaintiffs were limited to seeking declaratory and injunctive relief. (JORGENSEN and BIRKETT, concurring)
