The appellate court reversed defendant’s conviction of aggravated battery with a firearm, vacated the jury’s finding of guilty for reckless discharge of a firearm, and affirmed defendant’s convictions and sentences for felony murder and unlawful possession of a weapon by a felon. The Supreme Court granted defendant’s PLA challenging his remaining convictions and affirmed the appellate court, finding that the State proved defendant guilty beyond a reasonable doubt of mob action, the mob action properly served as the predicate offense for defendant’s felony murder conviction, the trial court’s exclusion of prior inconsistent statements was harmless error, and that no clear or obvious error occurred when the trial court did not sua sponte remove a juror. The Supreme Court also affirmed, finding that defendant could not establish cause for filing a successive post-conviction petitioner where the issue was not raised in his motion for leave to file a successive post-conviction petition and where it was previously raised in his initial post-conviction petition. The appellate court affirmed and the supreme court granted defendant’s PLA. The Supreme Court affirmed the judgments of the lower courts, explaining that while post-conviction counsel is required to provide reasonable assistance when adding a claim to a post-conviction petition, defendant failed to rebut the presumption of reasonable assistance raised by post-conviction counsel’s SCR 651(c) certificate. The Supreme Court also affirmed, finding that when looking at the factors relating to defendant’s age as well as the circumstances of the offense, defendant’s total sentence of 40 years in prison was not so disproportionate as to “shock the moral sense of the community,” and that the circuit court did not err in summarily dismissing defendant’s petition because it did not have an arguable basis in law. The appellate court reversed by finding that petitioner was not properly given the opportunity to respond to the State’s motion to dismiss her petition. The Supreme Court reversed the appellate court and affirmed the trial court, explaining that any error was harmless as a matter of law because petitioner was not entitled to relief under the statute where she was sentenced pursuant to a fully negotiated plea deal. Defendant argued on appeal that he was not proven guilty beyond a reasonable doubt of vehicular invasion. The appellate court affirmed, finding that the State met its burden where defendant was indicted and convicted on vehicular invasion by reaching and not entering the vehicle and that the reaching into the vehicle, which was simultaneous with a stabbing, met the definition of “force” under the vehicular invasion statute.
